Question: Should the sponsor stay and live in the US while parents are getting their green cards ?

Hello,

I am a US citizen but my parents are not(I had the citizenship after I was born in the US).

I am almost 20 years old living in the US, my parents are here too but they are under L1 and L2 visas( sponsorship, business visa ). When I’ll turn 21, my parents will be eligible for the green card(means they want to switch from visa to green card).. All their immigration requirements are met, the only problem, a few months after I turn 21, I will have to go to overseas because I want to work and live there.

Is it obligatory that the sponsor stays in the US untill his parents get the green card.

PS: Chances are I will come back to the US but after I have worked overseas for a few years.

Yes, you may have to stay in the us.

I would look at the official ice and state department websites. I would check it out with an immigration lawyer. I am sure that you have an immigration lawyer already working for you. If you don’t have one then you should get one.

I don’t think it matters where you live but you will need to be here for the various INS interviews, so it may mean some frequent traveling.

I would recommend contacting an immigration lawyer for advice.

Yes, you do have to be here, you have to go to an appointment with your parents to the INS office. I don’t remember if it’s 1 or 2 appointments you have to go to with them.

If your parents have an L1 or L2 visas (transfer visa), they have that because their company transfered them here. That company should be the one sponsoring them for their green card, i think it’s much faster.
