Q&A: CDN Visitor Parent, US Baby, What rights do the parents have in the US?
If on a visitor visa in the US, someone has a baby… I understand that the baby then qualifies for dual citizenship, but what about the parents? Clearly they are still CDN citizens on a visitor visa. Do they still continue to qualify for 6 month visitor visas or is there a different visa that they would qualify under? What if the parents want the child to be educated in the US, would the child have to go to the US on its own? Even as a minor?

The child can petition the Canadian parents for a green card when the child reaches 21. Other than that there are no right granted the parents for having a child born in the US!

no rights for parents since they do not hold US citizenship.
the child either stays in parent’s country or with a relative in the US.

The baby can petition the parent when s/he turns 21 years old and can prove the s/he can be responsible for parents financially. Just because you have US born baby doesn’t give parents any legal status.
